Another Texas politician is using his opposition to gay marriage in his effort to attract voters. Dan Branch is running to replace Greg Abbott for Attorney General. Greg Abbott, who is historically anti-gay, is running to fill anti-gay Governor Rick Perry’s soon-to-be-vacated spot.
Tuesday, Dan Branch filed a legal brief with the Texas Supreme Court opposing a lawsuit that seeks to overturn the state’s gay marriage ban.
From Branch’s brief:
Opponents of traditional marriage know that Texans believe strongly in the traditional institution of marriage—so Respondents cannot achieve their goals at the ballot box. They also know that they are wrong as a matter of constitutional law—so Respondents also cannot achieve their goals in this Court.
Accordingly, the only way that Respondents can try to impose their vision upon the people of Texas is to trample upon both the legislative process by which Texas laws are supposed to be written, and the adversarial judicial process by which constitutional disputes are supposed to be resolved.
The case that Branch is referring to is one of two cases before the Texas Supreme Court that deal with the issue of gay divorce. While gay marriage is not legal in Texas, some argue that the overturn of the Defense of Marriage Act should pave the way to legal gay divorce.
Dan Williams, of Equality Texas, told the Dallas Voice that this is just Branch playing politics:
“As the [appeals court] stated three years ago, and as anyone with an ounce of common sense can tell you, granting a divorce is not creating a marriage,” Williams said. “In fact the law is very clear: the ability to get a divorce is a benefit of living in Texas, not a benefit of marriage. If you don’t believe me, try being a non-resident and trying to get a divorce.”
Texas currently has a constitutional amendment that defines marriage as between a man and a woman.
